SECTION 01
Strategy Memo
Theory of the case, risk factors, discovery and motion plan.
Theory of the case
The State alleges that Mr. Park assaulted Elena M. Voss with a knifeSource 1. The defence theory rests on time: the State’s own documents disagree about when the incident occurred, and the client’s account places him at the Keller residence until about 9:40 p.m.Source 2.
THE TIMESTAMP PROBLEM (CRITICAL)
The State’s own documents assign different times to the incident:
| TIME | DOCUMENT | CONTEXT |
| 21:40 | Client narrative Source 2 | Leaves Keller residence (alibi start) |
| 21:55 | Neighbour memo, Ruth Keller Source 3 | Car heard leaving the drive |
| 22:15 | Incident report IR-23-0814 Source 4 | Time recorded in police report |
| 22:37 | Complaint / bail summary Source 1 | Time alleged in charging document |
| 08:05 | Crime scene log CSL-23-0814 Source 5 | Time in scene log |
The spread is more than ten hours. The defence will argue the State cannot establish when the incident occurred, let alone who was present.
Risk factors and mitigation
HIGH-RISK FACTORS
1. Irreconcilable timeline. Obtain the full incident reportSource 4 and the full crime scene logSource 5 to determine whether these times refer to different events.
2. Weapon chain of custody. The knife was logged without a continuous custody recordSource 6; move to exclude or test the gap.
CRITICAL PATH (FORWARD-LOOKING)
| STEP | ACTION | DEPENDENCY |
| 1 | Confirm current docket status; identify next hearing date | Clerk of Division 2 |
| 2 | Transcribe 911 call Source 7 | Transcription vendor |
| 3 | Obtain full IR-23-0814 Source 4 and CSL-23-0814 Source 5 | Records division |
| 4 | Reconcile the timestamps; prepare a unified timeline memo | Steps 2–3 |
| 5 | Obtain building camera retention records Source 8 | Building management |
